Bail Application Bundle

A bail application is one of the most time-pressured events in criminal proceedings. Whether it's being heard in the Magistrates' Court at first hearing, contested in the Crown Court after a refusal, or renewed following a material change in circumstances, the bundle has to be ready before the hearing starts, not assembled in the cells.

Unlike most criminal evidence, bail applications don't rely on a prosecution bundle served in advance. The defence typically drives the preparation: a concise summary of the bail application, a list of proposed conditions addressing the specific grounds on which bail was withheld, and supporting documents — a surety letter, an address letter, or evidence of employment — that show those conditions are realistic and reliable.

The governing framework is the Bail Act 1976 and Criminal Procedure Rules Part 14, and both the Magistrates' Court and Crown Court use specific forms for different types of application. Under CPR rule 14.8, a defendant appealing a magistrates' court refusal to the Crown Court must serve the completed form on the Crown Court, the magistrates' court, the prosecutor, and any proposed surety, and the Crown Court must hear it no later than the next business day.
