Preparing an FLR Refusal Appeal Bundle: What You Need to Know

Getting a Further Leave to Remain (FLR) application refused is unsettling enough without also having to work out, often within days, whether you even have the right to challenge it. The answer depends heavily on which FLR route the refusal falls under — and once a right of appeal does exist, the bundle you build for the First-tier Tribunal follows a very specific structure that's worth understanding before the clock starts running.

Not every FLR refusal is appealable

FLR isn't a single visa route - it's the umbrella term for several different in-country applications to extend or vary leave. The form used depends on the basis of the claim:

FLR(M) - partner and spouse extensions under Appendix FM
FLR(FP) - family or private life claims, including the 10-year Appendix FM route and the Appendix Private Life route
FLR(HRO) - human rights claims that fall outside the standard family or private life categories, often Article 8 or Article 3 based

What links these three is that they're all treated as **human rights claims**. That classification is exactly why most refusals under these routes carry a right of appeal to the First-tier Tribunal - the refusal of a human rights claim is one of the few categories of Home Office decision that the Immigration Act 2014 preserved a statutory appeal right for. Refusals under work or study-based Immigration Rules categories sit in a different bucket entirely: those usually only carry Administrative Review, a more limited internal Home Office process rather than an independent Tribunal hearing.
