Employment Appeal Tribunal (EAT) Bundle

An appeal to the Employment Appeal Tribunal is not a re-run of the Employment Tribunal hearing. The EAT only has jurisdiction to correct errors of law — it cannot substitute its own findings of fact for those of the tribunal below. That single distinction shapes everything about what the EAT bundle needs to contain and what it needs to argue.

The bundle starts with the notice of appeal, but crucially — under the EAT Amendment Rules 2023 — appellants are no longer required to include copies of the ET1 and ET3 with the notice. The Employment Tribunal's written judgment, with reasons, and any directions issued by the ET remain essential. Everything else builds toward the legal argument: the skeleton argument, the relevant passages of the ET record, and any authorities bundle setting out the case law relied on.

The EAT Practice Direction 2024 (in force from 1 February 2025) now incorporates guidance on the use of MyHMCTS for filing, and legal representatives are required to use the E-Filing service. Bundles sent to the EAT or the other parties less than 28 days prior to the hearing may not be considered by the Judge.
