Marriage Validity Bundle

Marriage validity disputes ask one fundamental question: was this marriage ever legally valid? They arise in nullity proceedings, where a marriage is challenged as void or voidable, and in applications for a declaration of marital status under the Family Law Act 1986, where a party asks the court to formally rule on whether a marriage exists at all.

Because these cases often turn on where and how a ceremony took place, and whether it satisfied the law of that country, the bundle needs to bring together the marriage certificate, witness statements describing the ceremony, and, where foreign or customary law is in question, expert evidence on that law.

Family court bundles for these proceedings follow strict structure under the current Practice Direction 27A: Bates-numbered sections, capped page limits, and a tight pre-hearing timetable that rewards early, careful preparation rather than a last-minute scramble.
